Custody And Visitation Agreement Decisions

If you are unable to come to an agreement with your ex regarding child custody and visitation, a judge will have to make the final decision for you. The judge’s decision will be based on what they feel is in the best interest of the child.

The following factors will be considered:

  • Your child’s age
  • Your child’s health
  • Your child’s emotional bonds with you and their other parent
  • Your and your ex-spouse’s means to provide care for the child
  • Any history of physical or substance abuse
  • Your child’s connection to home, school, and community

Our Hanford child custody and visitation lawyers will work with you to understand the facts of your situation and provide options to help you achieve your goals.

Types Of Child Custody in California

Child custody determines who your child will live with and who will make legal decisions for your child.

There are two types of custody:

  • Physical custody, which is the amount of time your child spends with each parent. Physical custody can be:
    • Joint: The child shares living time with both parents.
    • Sole: The child lives with one parent and visits the other parent.
  • Legal custody, which gives parents the rights to make decisions for their child in matters concerning school, health care, and well-being. Legal custody can be:
    • Joint: Both parents make decisions for the child.
    • Sole: One parent makes decisions for the child.

Types Of Visitation

If you or your ex-spouse has your child less than half of the time, the judge may order visitation rights.

Four types of visitation can be granted:

  • Schedule Visitation: To prevent visitation conflict, the court may develop a schedule that outlines when the child will spend time with each parent.
  • Reasonable visitation: With reasonable visitation, the parents decide on the dates and times the child will spend with each of them.
  • Supervised visitation: If the court feels that visitations with one parent need to be monitored, it will order supervised visits where the other parent or another adult is present during the child’s visit.
  • No visitation: If the court decides that visitation with one parent would be harmful for the child, it may decide to not give visitation rights to that parent.
