Custody and Visitation Agreement Decisions

If you are unable to come to an agreement with your ex regarding child custody and visitation, a judge will have to make the final decision for you. The judge’s decision will be based on what they feel is in the best interest of the child.

The following factors will be considered:

Types of Child Custody

Child custody determines who your child will live with and who will make legal decisions for your child.

There are two types of custody:

  • Physical custody, which is the amount of time your child spends with each parent. Physical custody can be:

Types of Visitation

Four types of visitation can be granted:

  2. Reasonable visitation: With reasonable visitation, the parents decide on the dates and times the child will spend with each of them.
  3. Supervised visitation: If the court feels that visitations with one parent need to be monitored, it will order supervised visits where the other parent or another adult is present during the child’s visit.
  4. No visitation: If the court decides that visitation with one parent would be harmful for the child, it may decide to not give visitation rights to that parent.
